Pravo na jednostrani raskid Ugovora
Samo kupci koji su potrošači imaju pravo jednostrano raskinuti ugovor. Ugovor postaje važeći u trenutku slanja paketa kurirskom poštom. Nakon što ugovor postane važeći, ne postoji mogućnost promjene ili otkazivanja narudžbe.
Jednostrani raskid
1. In order for the buyer to be able to exercise the right to unilaterally terminate the Contract, he must inform the Vallenssia-art shop of his decision to unilaterally terminate the Contract before the expiry of the deadline by e-mail to the support@vallenssia-art.com in to which he gives his first and last name, address, telephone number, or by means of the Contract Withdrawal Button.
2. Also, terminating the contract through the Contract Withdrawal Button that the user/customer sends electronically, the Seller will provide him, without delay, with a confirmation of receipt of the notification of Unilateral Termination of the Contract by e-mail.
3. Rok za jednostrani raskid ugovora iznosi 14 (četrnaest) dana od dana kada je kupcu ili trećoj osobi koju je kupac odredio, a koja nije prijevoznik, predana roba koja je predmet ugovora, odnosno u slučaju usluge od dana sklapanja ugovora.
Posljedice jednostranog raskida
If the Buyer unilaterally terminates the Contract, he will be refunded the funds received from him, without delay, and no later than 14 (fourteen) days after the Vallenssia-art shop or support@vallenssia-art.com online store receives the user’s decision to unilaterally terminate the Contract. The refund will be made to the IBAN account specified by the user in the unilateral termination of the Contract. Vallenssia-art can refund the money only after the goods have been returned to him.
The buyer is obliged to hand over the goods or send them to IDIZAJN vl. Snježana Blagšić, Blažićevo C 19/A, 51000 Rijeka, Croatia, without undue delay, and in any case no later than 14 (fourteen) days from the day on which he/she sent the Vallenssia-art shop its decision on the unilateral termination of the Contract. The customer shall bear the direct costs of returning the goods.
Before terminating the Contract, the buyer must call +385913290001 or contact the shop at the support@vallenssia-art.com kako bi vam objasnio postupak vraćanja robe.
Kupac odgovara za svako umanjenje vrijednosti robe koje je posljedica rukovanja robom, osim onog koje je bilo nužno radi utvrđivanja prirode, obilježja i funkcionalnosti robe.
The buyer is obliged to submit, when returning the goods, all supporting documentation and the submitted warranty certificate that was attached to the same, and the original packaging where the received item/s must be unused and undamaged in any way; otherwise, the Vallenssia-art shop is not obliged to refund the paid price.
If, at the request of the user, the performance of the service began during the deadline for unilateral termination of the Contract, the buyer is obliged to pay Vallenssia-art shop an amount commensurate with what was delivered by the time the user informed Vallenssia-art shop of the unilateral termination of the Contract.
Kupac nema pravo na jednostrani raskid ugovora ako je:
- usluga u potpunosti izvršena, a izvršenje je započelo uz izričitu prethodnu suglasnost kupca i uz njegovu potvrdu da je upoznat s činjenicom da gubi pravo na jednostrani raskid ugovora ako je usluga u potpunosti izvršena
- ako je predmet Ugovora roba koja je zbog svoje prirode nakon isporuke nerazdvojno pomiješana s drugim stvarima
- has concluded a contract for the supply of goods that are made according to the customer’s specifications or are clearly adapted to the personal needs of the customer. In the case of ordering goods according to the customer’s specification, i.e. when the buyer has requested the handmade goods according to the Vallenssia-art shop with the request for a specific dimension, size, colours, type of material, technique and the like, for example, when commisssioning art painting on canvas with a given motif or for example, making a stretched canvas on the wooden frame in dimensions according to the customer’s wishes, it is not possible to cancel the order, nor the refund of the money paid since such artwork cannot be used for further sale,
- roba zbog svoje prirode nije prikladna za povrat ili se može brzo pokvariti
- roba isteklog roka trajanja
- riječ o kupnji iz članka 72. Zakona o zaštiti potrošača, u skladu s člankom 79. točkom 4. i točkom 12. Zakona o zaštiti potrošača (personalizirana roba, digitalni sadržaj).
