Unilateral contract termination

Right to unilateral termination of the Contract

Only buyers who are consumers have the right to unilaterally terminate the contract. The contract becomes valid at the moment the package is sent by courier mail. After the contract becomes valid, there’s no possibility to change or cancel the order.

Unilateral termination

1. In order for the buyer to be able to exercise the right to unilaterally terminate the Contract, he must inform the Vallenssia-art shop of his decision to unilaterally terminate the Contract before the expiry of the deadline, by unequivocal statement sent by post (IDIZAJN vl. Snjezana Blagšić, Blažićevo C 19/A, 51000 Rijeka, Croatia), or by e-mail to the support@vallenssia-art.com in to which he gives his first and last name, address, telephone number, or e-mail address, and may also use the said written Form for unilateral termination of the Contract.

2. Also, the Form for unilateral termination of the Contract can be filled out electronically by the user/customer and sent in which case Vallenssia-art will provide him, without delay, with a confirmation of receipt of the notification of unilateral termination of the Contract by e-mail.

3. The deadline for unilateral termination of the Contract is 14 (fourteen) days from the day on which the goods that are the subject of the Contract have been handed over to the customer or the third party designated by the customer, which is not the carrier, the goods subject to the Contract have been handed over, or in the case of the service, since the conclusion of the Contract.

Consequences of unilateral termination

If the Buyer unilaterally terminates the Contract, he will be refunded the funds received from him, without delay, and no later than 14 (fourteen) days when the Vallenssia-art shop or support@vallenssia-art.com online store receives the user’s decision to unilaterally terminate the Contract. The refund will be made to the IBAN account specified by the user in the unilateral termination of the Contract. Vallenssia-art can refund the money only after the goods have been returned to him.

The buyer is obliged to hand over the goods or send them to IDIZAJN vl. Snjezana Blagšić, Blažićevo C 19/A, 51000 Rijeka, Croatia, without undue delay, and in any case no later than 14 (fourteen) days from the day on which he/she sent the Vallenssia-art shop its decision on the unilateral termination of the Contract. The direct costs of returning the goods shall be borne by the customer.

Before terminating the Contract, the buyer must call +385913290001 or contact shop at the support@vallenssia-art.com in order to explain the procedure for returning the goods.

The buyer shall be liable for any impairment of the value of the goods resulting from the handling of the goods, except that which was necessary to determine the nature, characteristics and functionality of the goods.

The buyer is obliged to submit when returning the goods all supporting documentation and submitted warranty certificate that was attached to the same, and the original packaging where the received item/s must be unused, undamaged in any way, otherwise the Vallenssia-art shop is not obliged to refund the paid price.

If, at the request of the user, the performance of the service began during the deadline for unilateral termination of the Contract, the buyer is obliged to pay Vallenssia-art shop an amount commensurate with what was delivered by the time the user informed the Vallenssia-art shop of the unilateral termination of the Contract.

The buyer is not entitled to unilateral termination of the contract:

if the service is fully fulfilled and the fulfilment has begun with his explicit prior consent and with his confirmation that he is aware of the fact that he will lose the right to unilaterally terminate the Contract if his service is fully fulfilled,

if the subject matter of the Contract is a commodity which, due to its nature after delivery, is inseparably mixed with other things,

has concluded a contract for the supply of goods that are made according to the customer’s specifications or are clearly adapted to the personal needs of the customer. In the case of ordering goods according to the customer’s specification, i.e. when the buyer has requested the handmade goods according to the Vallenssia-art shop with the request for a specific dimension, size, colours, type of material, technique and the like, for example, when ordering to create an art painting on canvas with a given motif or for example, making a stretched canvas on the wooden frame in dimensions according to the customer’s wishes, it is not possible to cancel the order, nor the refund of the money paid since such artwork cannot be used for further sale,
goods due to their nature are not suitable for return or can quickly spoil,
the goods have expired,
if this is a purchase referred to in Article 72. consumer law, and in accordance with Article 79(4) and point 12. Consumer Protection Act.

FORM FOR UNILATERAL TERMINATION OF THE CONTRACT
